Employment Policy

This Employment Policy Agreement (the "Agreement") is entered into between AdeTom Tutors, hereinafter referred to as the "Company," and the Tutor, hereinafter referred to as the "Employee."

1. Prohibition on Client Poaching

Tutors are strictly prohibited from poaching clients engaged with AdeTom Tutors. Any attempt to solicit, recruit, or otherwise attract clients for personal gain outside the services provided by the Company is expressly forbidden. In the event of such poaching, legal action will be taken against the Tutor resulting in the full reimbursement of any amount paid to the Tutor for such services, and the Tutor will be held liable for any legal fees incurred by the Company.

2. Restriction Period

Tutors are prohibited from poaching clients for a period of one year following the termination of their engagement with AdeTom Tutors. Any violation of this restriction will result in the full reimbursement of any amount paid to the Tutor for such services, and the Tutor will be held liable for any legal fees incurred by the Company.

3. Property Damage Liability

Tutors acknowledge and agree that they are solely responsible for any damage caused to property during the provision of tutoring services. The Company will not be held liable for any damages, and the Tutor is responsible for addressing and resolving any disputes related to property damage directly with the affected parties.

4. Liability for Misconduct and Discrimination

Tutors are liable for any wrong conduct, including but not limited to misconduct and religious discrimination projected onto clients. The Company will not be held liable for such actions, and the Tutor is solely responsible for any legal consequences arising from their behavior.

5. Intellectual Property Usage

Tutors are strictly prohibited from using any intellectual property provided by AdeTom Tutors for services that are not affiliated with the Company. In the event of unauthorized use, tutors will be required to reimburse the entity for the full amount they received for the services in question. Furthermore, tutors will be held liable for any legal fees incurred by AdeTom Tutors related to the misuse of intellectual property.

6. Agreement Termination

Either party may terminate this employment agreement with written notice. Termination by the Company due to a violation of this Agreement, including client poaching, misconduct, or intellectual property misuse, may result in legal action, and the Tutor will be liable for any associated legal fees.

7. Liability for Accidents or Incidents

AdeTom Tutors shall not be held responsible for any accidents, injuries, or fatalities that may occur to the Tutor while providing services on behalf of the entity. Tutors are advised to take appropriate precautions and ensure their own safety during the provision of tutoring services. The Tutor acknowledges that they are solely responsible for their well-being and any unforeseen incidents that may occur during the course of their services.

By applying to join the team of tutors, the Tutor explicitly agrees that AdeTom Tutors will not be held liable for any accidents, injuries, or fatalities that may happen while performing duties on behalf of the entity.

8. Electronic Acceptance

By applying to join the team of tutors, the Tutor acknowledges that they have read, understood, and agree to abide by the terms and conditions outlined in this Employment Policy Agreement. The Tutor further agrees to responsibly read and stay informed of any updates to the Employment Policy online.

What information does the entity collect and how?

AdeTom Tutors collects a range of information about you. This includes:

  • your name, address and contact details, including email address and telephone number;

  • any personal information you have included in your curriculum vitae (CV) for example date of birth, gender, race, disability, marital status etc.;

  • details of your qualifications, skills, experience, and employment history;

  • information from interviews and phone-screenings you may have;

  • information about your criminal history, including convictions, offences, criminal allegations and proceedings;

  • information about your current level of remuneration, including benefit entitlements; and

  • information about your entitlement for employment.

We may collect this information in a variety of ways. For example, data might be contained in application forms or CVs (including when these are sent to us through this website, or from employment agencies, as part of speculative applications, referrals, or queries), obtained from your passport or other identity documents, or collected through interviews or other methods of assessment recorded or unrecorded on video platforms such as Skype and Zoom
We may also collect personal information about you from third parties, such as references supplied by former employers. We will seek information from third parties only once a job offer has been made to you.
Data will be stored in a range of different places, including on your application record and Tutor Profile, in our HR management systems and our email system.
We use Wix to process your job application.  Wix may collect data on the usage of its site or require the use of cookies as per its Privacy Policy (https://www.wix.com/about/privacy)

We use Skype and Zoom  to conduct our interviews.  Skype or Zoom may collect data on the usage of its site or require the use of cookies as per their Privacy Policy's (SKYPE: https://www.skype.com/en/legal/) (ZOOM: https://explore.zoom.us/en/privacy/)


Why do we process the personal information?
It is necessary for AdeTom Tutors to pursue its legitimate interests to process personal information during the recruitment process and for keeping records of the process. Processing data from job applicants allows us to manage the recruitment process, assess and confirm a candidate’s suitability for employment and decide to whom to offer a job. We may also need to process data from job applicants to respond to and defend against legal claims. The data may also be used for internal investigations, where apposite.
In some cases, we need to process data to ensure that we are complying with our legal obligations. For example, we are required to check a successful applicant’s eligibility to work before employment starts.
We will not use your data for any purpose other than the recruitment process of which you are a part and as part of the onboarding process if you are successful in your application.


Who has access to personal information?
Your personal information may be shared for the purposes of the recruitment process. This includes sharing with members of the HR team, interviewers involved in the recruitment process, and managers in the business area with a vacancy.  The sharing of your data may be with recruitment specialists within approved third parties if their access to your data is necessary for the recruitment process at AdeTom Tutors.
We will not share your personal information with other third parties unless your application for employment is successful and we make you an offer of employment. We will then share only what is necessary of your personal information with former employers to obtain references for you, employment background check providers to obtain necessary background checks and credit bureaus, the South African Police Services, or other third parties, to obtain necessary criminal records and/or credit checks.
In addition, we may need to share your personal information with a regulator or otherwise to comply with the law.
Change of purpose
We will only use your personal information for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose.  If you wish to get an explanation as to how the processing for the new purpose is compatible with the original purpose, please contact us at admin@adetomtutors.com with the subject line “Employment Privacy Policy”.
If we need to use your personal information for an unrelated purpose, we will notify you and we will explain the legal basis which allows us to do so.
Please note that we may process your personal information without your knowledge or consent, in compliance with the above rules, where this is required or permitted by law.


Disclosures of your personal information
We require all third parties to respect the security of your personal information and to treat it in accordance with the law.

 

International transfers
In respect of South African citizens, we will not transfer your personal information to a country outside of South Africa unless safeguards are in place to protect your personal information in comply with the requirements of POPIA.


Data security
We have put in place appropriate security measures to prevent your personal information from being accidentally lost, used, or accessed in an unauthorised way, altered, or disclosed.  In addition, we limit access to your personal information to those employees, agents, contractors and other third parties who have a business need to know.  They will only process your personal information on our instructions, and they are subject to a duty of confidentiality.
We have put in place procedures to deal with any suspected personal information breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

 

Data retention
We will only retain your personal information for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.
To determine the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorised use or disclosure of your personal information, the purposes for which we process your personal information and whether we can achieve those purposes through other means, and the applicable legal requirements.

In some circumstances you can ask us to delete your personal information.
In some circumstances we may anonymise or de-identify your personal information (so that it can no longer be associated with you) for research or statistical purposes in which case we may use this information indefinitely without further notice to you.

 

No fee usually required
You will not have to pay a fee to access your personal information (or to exercise any of the other rights). However, subject to applicable laws, we may charge a reasonable fee if your request is clearly unfounded, repetitive, or excessive or we may refuse to comply with your request in these circumstances.
What we may need from you
We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal information (or to exercise any of your other rights).  This is a security measure to ensure that personal information is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

 

Time limit to respond
We try to respond to all legitimate requests within one month.  Occasionally it may take us longer than a month if your request is particularly complex or you have made a number of requests.  In this case, we will notify you and keep you updated.
